According to a study by the National Institutes of Health, around 25,000 children get injured by exercise equipment each year. Because minors are more likely to get hurt, it’s the manufacturer’s responsibility to ensure that their products are safe and have warnings for children. If a member of your family has been injured because of an issue with a defective or improperly labeled workout machine, you should speak to a lawyer and file a product liability claim.
Recent Accidents With Peloton Products
In the first three months of 2021 alone, there have already been two unfortunate accidents involving Peloton Tread+ treadmills. One resulted in the death of a young child, and the other sent a 3-year-old boy to the hospital with serious injuries and brain damage. It’s unclear if these products have a defective machinery flaw that poses a threat to children, but the U.S. Consumer Product Safety Commission (CPSC) is currently investigating these tragic incidents. As recently as October 2020, Peloton recalled over 27,000 bike pedals because riders noticed that the pedals frequently broke during use, which caused deep cuts on their legs and feet.
UPDATE: May 17, 2021
After initially resisting calls from the CPSC and other consumer safety groups, Peloton recalled close to 125,000 of its Tread and Tread+ products on May 5, 2021. Reports have linked over 70 injury-related incidents to Peloton’s treadmills. In a statement, Peloton CEO John Foley apologized for the company’s earlier reluctance to recall its products.
What to Do If You’ve Been Hurt by a Defective or Mislabeled Product
If you or a loved one has suffered injuries while using workout equipment as intended, seek medical attention as soon as possible and have your doctor thoroughly document each injury. Then, write down the product’s serial number and take photos of its warning labels. This information will help a product liability attorney build a case for compensation to cover your medical bills and emotional damages. These lawsuits do more than protect your family; they also inform the public of serious issues with popular products.
