SETTLEMENT ALERT AT JURY SELECTION

This matter was settled on the morning of jury selection for a 54-year-old man hit by a car pulling out of a driveway. Leav and Steinberg LLP Partner Edward Steinberg resolved the case in April 2025, stemming from the car accident that occurred in November 2019.
The Accident and Its Aftermath
The Plaintiff, a then 49-year-old man, was driving his car when the Defendant pulled out of the driveway of her parents’ home and struck him as he was proceeding past. He was struck on the passenger side rear quarter panel.
The Plaintiff did not seek medical attention but followed up the next day when he felt uncontrollable pain in his neck.
Before the accident, the Plaintiff had an onset of pain in his neck and back, but this resulted in only an MRI and a doctor visit. He claimed all of the pain had subsided, and he was in good health before the accident.
After several months of conservative care and pain management, the Plaintiff underwent surgery, a cervical spinal surgery, and then a lumbar surgery. The lumbar surgery did result in a seroma developing, which had to be surgically removed.
The Plaintiff, a working man, missed work for several months during each surgery but was not claiming loss of earnings, as he had tried to return to work and was doing the best he could.
Building a Strong Case for Damages
The New York City personal injury attorneys at Leav & Steinberg LLP affirmatively made a motion to win the liability in this case, and by order of the Court, summary judgment was granted in November 2021. The matter was proceeding to trial on the issue of damages. The Defendant’s doctors had issued reports and were prepared to testify that any of the sequelae of this accident was minimal and that any surgery was the result of his prior degenerative conditions, for which this impact could not have caused an exacerbation of his symptoms.
Leav & Steinberg LLP retained a body shop and repair expert to testify that while the visible damage to the car was limited, the damage to the undercarriage, control arms, and wheels was extensive, and could have caused injury to the vehicle’s occupants.
Furthermore, the Plaintiff intended to call his own surgeon, who would have testified that the change in the Plaintiff’s pain and complaints was consistent with the happening of this accident.
